Users may distribute the binary or source code to third parties provided that this statement appears on all copies and that no charge is made for such copies.

Regarding the commercial use of SeaDAS, be aware that SeaDAS does integrate software from several sources which may include embedded copyright notices and which may have some limitations with respect to commercial sales. Specifically we include the NCSA HDF libraries, a few instances of source code developed by the University of Miami and used in OBPG data processing, and modified versions of ITTVis's IDL programs. Anyone considering modifying and selling SeaDAS should read all the embedded copyright and copying notices and proceed at their own risk.
By copying this software, you, the user, agree to abide by the conditions and understandings with respect to any software which is marked with a public domain notice.
The main portion of the SeaDAS software was developed by:
1. The SeaDAS Development Group at NASA GSFC, Greenbelt, Maryland
2. The Ocean Biology Processing Group(OBPG) at NASA GSFC, Greenbelt, Maryland
The SeaDAS software product also includes:
1. The HDF libraries which were developed by the National Center for Supercomputing Applications (NCSA) at the University of Illinois (UI)
2. Modified IDL procedures originally developed by ITTVis.
The United States, NASA and NASA affiliates, including, but not limited to, contractors, subcontractors, grantees and other affiliates, shall neither be liable nor responsible for any maintenance or updating of SeaWIFS data and related software, or for correction of any errors in the SeaWIFS data and related software.
The SeaWIFS data and related software is provided "as is" without any warranty of any kind, either expressed or implied, or statutory, including, but not limited to, any warranty that the SeaWIFS data and related software will conform to specifications, any implied warranties of merchantability, fitness for a particular purpose, and freedom from infringement, and any warranty that the documentation will conform to the SeaWIFS data and related software, or any warranty that the SeaWIFS data and related software will be error free. This agreement does not, in any manner, constitute an endorsement by NASA of any test results, resulting designs, hardware, or other matters resulting from use of the SeaWIFS data and related software. The User shall not file any claim against the United States or developers of the SeaWIFS data and related software for any matter concerning the SeaWIFS data and related software, performance of, failure to perform, breach or other matter related to this agreement. The User's sole remedy for any such matter shall be the immediate, unilateral termination of this agreement. The United States and the developers of the SeaWIFS data and related software shall not be liable for any damage or injury suffered by the User or its representatives, regardless of cause, and the User hereby expressly waives any rights it might otherwise have under the Federal Tort Claims Act or any other authority, in consideration for NASA's agreement to provide the SeaWIFS data and related software under this agreement. User, under this section, includes any further user to which the User provides the SeaWIFS data and related software and/or works based upon the SeaWIFS data and related software.
The User shall indemnify and hold harmless the United States and the developers of the SeaWIFS data and related software from any third party liability arising under the Federal Tort Claims Act or any other authority, out of the SeaWIFS data and related software, or out of performance of, or failure to perform, any aspect of this agreement, whether or not caused by the negligence, gross negligence or willful misconduct of employees of the United States or the developers of the SeaWIFS data and related software. User, under this section, includes any further user to which the User provides the SeaWIFS data and related software and/or works based upon the SeaWIFS data and related software.
This agreement shall be subject to United States federal law only, for all purposes, including, but not limited to, determining the validity of this agreement, the meaning of its provisions, and the rights, obligations and remedies of the parties.
This agreement constitutes the entire understanding and agreement between the parties hereto relating to the use of the SeaWIFS data and related software and may not be superseded, modified or amended, except by further written agreement duly executed by the parties.
